I am a single father that has never been married with primary residential custodial rights and the only caregiver. I was awarded primary parental rights after the biological mother was arrested for using the diaper bag as a cover up in the commission of a crime. Once arrested my child was taken into state custody and the maternal grandparents was notified and was allowed temporary custody without my knowledge of any of this happening, Once the grandparents gained custody of my child they called me and threatened me that if i tried to make contact with my child, that they would have me arrested for attempt of child abduction. Seeing that the biological mother left the last name of the child the maternal name (Briggs) instead of Jones which is my last name. I was present for the delivery of my child at the hospital, but once i arrived i went to the delivery room and was greeted by the maternal grandmother. The doctor in the room looked up and said that only one of us could be in the room during the delivery. I said that i was staying and the maternal grandmother said that she was too. The doctor looked at me and asked if we was married and i had to say no. He said that the next of kin has the right. So i was asked to leave the room. Now i understand why it was so important to not have me in the room. To leave the child's last name the maternal in hopes they could exclude me from the child's life. After 4 years of being forced to stay away by threat of arrest and after the maternal grandmother gained custody. She finally decided to allow me to see my child. She then informed me that she was going to take me to child support court. I was happy because i had faith in the system that by being willing to comply with all the rules and regulations that i would be able to finally get to know my child and she (my child) would be able to get to know her father. The first day i was allowed to see my child she was 4 years old at the time. She was riding her tricycle in the front yard when i pulled up. She stopped in her tacks and was steering at the car in the driveway. She got off her tricycle and came running to me crying, Daddy, Daddy, Daddy..

As we stood there crying and hugging, the maternal grandmother walked up and the first thing out of her mouth was i am taking you to court. As i said i placed faith in the system. But as the proceeding continued i discovered that the court was trying to hold me responsible for back child support. I spoke up and showed the court the proof of me being threatened to stay away. So they said by law that they could not hold me responsible for the back child support based on the facts presented. But what they did was they held both biological parents responsible to reinstate the state for the birthing cost and granted the maternal grand parents custody. Well i have been paying the arrears for the past 9 and a half years to the tune of $16,347.27. The biological mother has never been pursed. This is a violation of the equal protection of the law. But nonetheless i have discovered that the birthing cost was never paid for by the state, it was done on the maternal grandparents private insurance. This is why the court has failed to supply me after numerous request for a itemized invoice showing how they arrived at this amount they have held me to repay. This is my right as a consumer under the consumer protection act.

I finally was awarded custody because the maternal grandparents beat my child leaving bruises down her legs and across her back. I showed the photo's of the marks to the child support judge and he did nothing to protect my child. Leaving her in harms way. That day after the grandmother got home from court and my child got in from school, they took it out on the child once again.

For the court to grant custody to a third party with claimed rights over those of a natural and biological parents fundamental rights under the constitution of the united states. Violates everything the system states they stand for (The Child's Best Interest)!

But nonetheless they left the child in this violent environment and drug abuse to the point that the Maternal Grandfather tried to commit suicide in front of the children on Christmas day 2006 because of a bitter divorce that was playing out in front of the children as the two grandparents was still living together arguing and fighting in front of the children and the courts never once stepped in once they became aware of the situation. My child witnessed her biological mother being dragged out of the maternal grandparents home by the hair of her head after she ran and hide in a closet when the police knocked on the door looking for her over a warrant.

Only after i filed a petition in family court did i ever see any turn around in the situation. But i need to add that even that court did not want to do the right thing for the child. I was PRO SE meaning i did not have legal representation. I stood and was accountable by myself. Only after i raised the issue of my constitutional rights being violated in many ways did the court take a huge step back and understood i was educated enough to understand the violations that has been plaguing my family situation for many years was brought on by the system failing to protect and preserve the oath of office and the state and federal constitutions. This is a on going litigation with the General Assembly and the Court Of The Judiciary.

The fact that the courts have imposed on me (the biological natural father) a ridiculous amount of arrears unjustly, they have impeded my abilities to raise my child with all options available and i have to view this as being totally Bias and Prejudice based on gender. Because there is no other explanation.

Now that i have had a court ordered Child Support Order in place for the past 4 years i see that there is a double standard and a blatant disregard for the orders issued by the court by not enforcing them on the opposite sex (Female) but they go all out to enforce it on the male. I know i have lived this and continue to live this today because they have just issued a Automatic Jail Order for the arrears they say i owe, when they have not collected a single dime from the biological mother and she walks free..

The biological mother is a convicted felon of numerous accounts, child abuser and neglects. She even took back Christmas gifts i bought my child that my parents helped
get. Because i spent every dime i had on paying child support and found a way to still do for my child. She took them back and exchanged them in order to get receipt. Then took them to a different store and got refunds on the items. She did this to buy her deadbeat boyfriend beer.

See why i am so bitter about all of this is because my parents, my child's paternal grandparents was denied access to my child while i was. The courts allowed this to continue. My child was only allowed to get to know her grandparents now for 4 short years. My mother just passed away October 15th 2009. I was the last person to see and talk to my mother. We without knowing the days events, talked about this very subject. She told me that she was proud of me for standing up against all odds. She told me that loved me. She said that she sees a flaw in me and that she wanted me to fix it. This flaw she said is one i have myself and i wish had changed it too. The flaw was that i always care about other people feelings to the point i allow people to walk all over me. She said i do it too. She said "Son, you have got to learn how to just say it" ! You have got to stop holding things in and carrying them around. She made me promise her that day that i would just say it. She would not let it go. She said i am proud of the man you have become and i want you to know that i love you. I will always be here for you and i encourage you to reach for your dreams as i always have. Our last words was "I Love You" . i got the phone call just 1 hour later informing me that she had just passed away. The phone call was from my father that had found her.

See i gave my mother a promise, but i did not know that it was her dying wish for me. I am focused on correcting these issues no matter what lengths i have to go to in order to achieve this.

This is how the state capitalizes off your children doing without. Or even if child support is paid. They get dollar for dollar for money collected or people housed in jail. The state gets paid while you and your child suffers. The state is the only ones that benefit by the funds the federal government gives goes into the GENERAL FUND. Remember the general fund? Disney world trips for the whole family out of that very same general fund? $1000 plate dinners? Remember? This is why they take such a interest in collecting. The local governments private banking system.....at the cost of your children. Don't you think it bothers your child to see their parent go to jail? Or being stressed out all the time? What do you really think your child thinks about you being the one that puts the other parent in jail? They know it is you doing it because kids talk and other kids at school knows what you have tried to keep from your child. In time they will see you for what you are and what you have done to their family lives, emotional stability.This interrupts the one on one time that parent and child deserves...

The need for an effective child support program is clearly supported by a brief review of the demographic trends of the American family. By 1998, there were an estimated 11.9 million single-parent families with children under age 18; about 9.8 million (82 percent) maintained by the mother and roughly 2.1 million maintained by the father. It appears that the rate of growth in the number of single parents has stabilized (Office of Child Support, 1995a, p. 5). The average annual percent increase in the number of one-parent families was 2.3 percent from 1990 to 1998 and 4.1 percent from 1980 to 1990 as compared with 8.2 percent from 1970 to 1980. In 1998, one-parent families comprised nearly 32 percent of all families. The corresponding share of single-parent families in 1970 was 13 percent. In 1998, about 40 percent of the mothers had never been married, 34 percent were divorced, 21 percent were separated from their spouse, and about 4 percent were widowed (U.S. Census Bureau, 1998, p. 36).

The TRUTH has been right infront of us all along!

I firmly believe i know what has damaged the health care industry. Allow me to explain? My mother (Carolynn Bernice Jones)as seen in the photo above along with me(Howard E. Jones). My mother passed away a little over a month ago. October 15th, 2009. She left this world early because the fact that she could not get approved for adequate health care coverage being low-income and disabled. This after i had just learned that the biological mother of my child (which i have primary custody of) was allowed by the state of Tennessee and the Department Of Human Services to get full coverage insurance not only on herself but the three children she never had legal custody of or the legal rights to claim by way of a 1997 court order. She never has even taken care of the children. She was proven unfit by the Maternal Grandparents back in 1997 for drug and alcohol abuse and neglecting the children and as of today has never complied with the courts guidelines to even regain standard visitation of the children as of November 2009.

I find this totally repulsive to know that My MOM could very well still be with us today if it had not been for the Department Of Human Services not doing their job in the way of NOT investigating the claims that they processed. I find this very discriminating because i seen how they treated me when i had to apply for help because the biological mother fails to pay her court ordered child support or provide health insurance for the children or anything else for that matter.

She was allowed to gain and renew the policy of a H.U.D. Home Choice Voucher, Food-stamps, Insurance, etc.Which was allowed to be used on a property that i have a court order prohibiting her to be on the property(Which was the Maternal Grandparents home), All of this in her name as the policy holder with all three children being claimed as dependent children of hers which in it's self violates the court orders in place. They never questioned her eligibility as they made me prove that i had court ordered custody,my income,my utility costs, Birth certificates,Social Security Cards,etc and i provided all the above and they still did not want to help me. But the biological mother had no questions presented to her about her claim. Don't you as a taxpayer find this totally unexceptable and Discriminating against the genders? (Unconstitutional for a government affiliated agency to discriminate.)

They will allow a convicted felon that has been deemed unfit by the state, to apply for public benefits claiming the very same three children she has been deemed unfit to even have contact with via courts orders. How can a Government affiliated agency not have access to the records on file in the very same county the court proceedings took place? I mean they have the Social Security Numbers for a reason right? Am i the only one here that sees this as being a huge problem? Not only for the health care industry being strained by people that should not have access to benefits once they have waived their eligibility by committing crimes and neglecting the very same children the State Of Tennessee and the Department Of Human Services, Child Support Court and the federally funded Child Support Enforcement Agency allowed her to claim. Then allowed the biological mother to pursue me in Child Support Court while the Maternal Grandmother held custody of my child and the Maternal Grandmother was also allowed to pursue me in child support court as well. I only have one child by the biological mother and i was being billed twice for the one child. Because the Child Support Enforcement Office had two active cases against me for years. I paid two different sums of money each and every month. I addressed the Child Support Court and the States Attorney's Office with the fact of me being double billed and they told me to only pay one of them. So i did and as i paid each month the amount of $357 with $50 of that being arrears payments. I watched each month the out standing balance never decreased it always went up by $200 plus a month. I have primary custody of my child today and the date i was awarded primary residential parenting rights because of physical abuse in the home of the Maternal Grandmother and a attempted suicide on Christmas Day 2006 in front of the children with a loaded weapon by the maternal grandfather coupled with countless contempt findings for violation of court orders which resulted in the removal of my child from that household. But the sad part is that my child has siblings that was in this home as well and the court and the states attorney's office left those children in the custody of the maternal grandmother. Once my child came to live with me the maternal grandmother then turned her sights on my child by way of threatening my child. The maternal grandmother told my child that she would make her regret deciding to come live with me. She fulfilled that threat by packing up my daughters siblings and moving out of state. I later discovered the true reason she left this state was because she had helped the biological mother apply for the public benefits by way of giving the paper work such as Social Security cards, Birth certificates, and allowed her to pretend that she has legal custody of the children while she lied about the situation to gain privileges by false pretenses. Making the grandmother co-conspirator of the fraud that was committed by the biological mother.

I was awarded Primary Custodial Parenting Rights January 23, 2005. I addressed the Child support Court about the sum they still today say i owe the State of Tennessee for the payments granted to the biological mother unlawfully and they said i still have to pay that amount which is $11,354.00 . Which is totally unconstitutional to force someone that did not commit the crime to be force to pay restitution.

This matter should capture every bodies attention even if you do not have children or even if you do not have a case that involves the State. Because this is your TAX DOLLARS they are just handing out freely to criminals and felons that neglect their children and still get paid your tax dollars because they (Department Of Human Services) do not get questioned about their position or status in the situation.

Let me give you all a quick break down as to how the system works? You see the FEDERAL government pays local municipalities dollar for dollar collected in child support cases(Federal Kickbacks). Meaning if they collect $500 a month in child support payments the local Authorities get $500 federal dollars that goes into the GENERAL FUND. The same happens when you have a case that the child support system does not collect child support from the NON-custodial parent in the involved case and they incarcerate the noncustodial parent in the local jail system. They collect from the federal government between $50-$100 a day per person housed in the jail system for violation of child support orders. That money to goes into the GENERAL FUND. Now let me explain what the GENERAL FUND IS? The general fund is used for any purpose. It is money that is not controlled by the Federal Government. This in Knox County Tennessee was the vary same General fund that was discovered in 2007 of being used for local politicians personal uses. The Mayor of Knox County Mike Ragsdale and his administration has been pulled into question about charges made on the departments p-card purchases(Government Issued Credit Cards). They took Disney World Trips for the Whole Family on the taxpayers dollar. Paid for $1000 a plate dinners, bought expensive vehicles above and beyond reason for duties and then drove them as their personal vehicles while not on the clock for regular business hours. Now tell me, Does it make sense as to why the Local Municipalities would be so BIAS, and Prejudice of Child Support Matters? They place ridiculous arrears amounts on innocent hard working carrying, nurturing parents. That they know from the start by calculating the income that the parent will not even be able to survive let alone have anything to pay. The Child Support Court hides this behind the statue of "Child's Best Interest" Is nothing more than a cover up for the backdoor dealings with the Federal Government to boost the General Fund that they use for their own personal uses while the child is left suffering they are out having $1000 plate dinners while the child goes hungry. They are driving HUMMERS and Large flashy SUV's while the child catches the bus. They go and get BOTOX injections so they look Charming while they lie through their teeth.

This is exactly what is going on with the Health care industry but on a much larger scale. Doctors charge the insurance Companies inflated rates which drives up the premiums for everyone else. Just the same when a thief steals from Walmart, that loss is rolled out to everyone going through the checkout lanes. Same thing with the insurance companies. Same thing with raising taxes so that local politicians can reach deeper into that GENERAL FUND without being detected.

Think about it people. WHO is really taking the punch here? OUR CHILDREN!and the primary care givers that are forced to say no to things that child has worked so hard to gain the rewards for. Such as good grades, going to a ball game etc. They are the ones that are going to be forced to pay all this back into the system so that later on down the road the next generation of Politicians can do your children even more harm than good.Just like the jokes that are in office today. Only thingthat changes are the faces that lie to you!

We have got to take a stand. We have got to make the change for the better. These people that are in power as we speak have only set us back 30- 40 years in time economically. We will never see the day the economy will rebound. That is a load of garbage. The damage is done and they have forced us to live a lie so long now they are trying to believe the crap now too.History repeats it's self. They know that there is no fixing the government policies. It is to far gone. It reaches to far to turn back now. The next great thing we can do for our Society is to allow government to fail. Let it hit rock bottom! Just like drug addicts. They never do better until they have no where else left to turn. Then and only then will this Country start to move forward again. Start over from scratch. Take what has happened as a learning tool. Lesson learned!

But we have got to do something for our children. That is our future as a country and a Society. The answer doesn't consist of these bailouts they keep throwing at these very companies that got us into this mess in the first place. The Government keeps giving the crackheads the drug of choice. OUR TAX DOLLARS!

WAKE UP! can't you see what they are doing here? Our children's future is a black hole. WE THE PEOPLE HOLD THE LIGHT! We hold the power of change. We have got to stand for something and this is the cause of the future if there ever will be a better tomorrow. We need change, and i am not talking about whats in your pocket!

We need to make our voices heard! We need to quit seeing things as "They'll Work It OUT"!
